Please bear in mind that the courts in some circumstances will say that case law is binding, while in other circumstances will hold that each case must be judged on its own merits. There will also be instances where case law conflicts and the law continues to evolve. While bearing these points in mind, refering a judge to existing case law may assist in supporting an argument to the court.  Our caselaw categories include summaries and the full text of judgments to download, wherever they're made public.

Now you can read judgments and other reference material on your kindle, ipad, iphone or tablet reader, using free kindle software and with content reformatted by The Custody Minefield. You'll need to download Amazon's free Kindle software from here to be able to open and read our Kindle format reference guides.

Case Law

Freely available case law in family proceedings is limited. Decisions which have been made public by the High Court (Family Division) can be found on the website provided by the British and Irish Legal Information Institute (BAILII).
